What if I want to put in a irrigation well, can i get a certain percentage of my neigbiors in the subdivision to sign off on it and be OK (not be suceptable to legal recourse)?
Who enforcesd deed restrictions after developer leaves and there is not a Home owners association.?
No. The restriction is for perpetuity. If you violate the restriction, any neighbor can utilize a civil action to enforce the restriction and will prevail on a prima facie basis if they provide evidence that you have violated the restriction.
